Microsoft Wants Google Hiring Stopped | |

Microsoft announced late Tuesday that it would be pursuing legal action against Google as well as a former executive that jumped ship to the search giant in an effort to prevent his hiring. The executive, Kai-Fu Lee, was a vice president of Microsoft's Interactive Services division. Lee's new role with Google will be as head of the company's new Chinese research and development center. Google announced Lee's hiring on Tuesday as part of a press release regarding the center's opening - a rare occurrence as the company normally does not publicize the hiring of new executives. | ||

See, this sucks. The man has a right to a job he can obtain in his chosen profession. Contractual clauses like this one should be outright illegal. If MS is afraid he'll pass on info he shouldn't, maybe they should have taken precautions to protect it better. MS lost a good guy, and you have to ask why.
Non-compete clauses should be outlawed. |

| Non compete clauses in executive employment contracts are standard fair in many industries. The only advice I can give is to negotiate the severance package for as long as the non compete period. Its a win-win. You get needed time off with pay; the employer doesn't have to worry about you giving the competition the latest wing bang stuff you and your team were working on when you left the company. |
