Just when it looked as if Microsoft had thrown in the towel in the ongoing patent infringement case involving Toronto-based i4i, the Supreme Court has agreed to reconsider Microsoft’s appeal. The case will examine what should constitute the proper legal standard for determining a patent’s validity. | ||

Hmm. Evil, notorious patent-abuser Microsoft versus evil software patents. Who do I root for? My head might asplode...
MS, just pay the bill and learn that the days of you stealing technology from potential partners and then steam-rolling them are gone. You got caught red-handed, you lost in court and now it's time to pay up. If the situation was reversed and MS had sued i4i and i4i lost, would the Supremes be in a hurry to hear i4i's appeal? Or is this MS calling in political favours? While I'm all in favour of patent reform, somehow I suspect MS will gets its way and not have to pay but bogus software patents will still be upheld. |

| I hope Microsoft wins their case against i4i only by unwittingly convincing the high court to create a legal standard that also invalidates the majority of Microsoft's software patent portfolio. Unfortunately, however, I don't foresee that occurring. |

Hmmm... let's see poor little Canadian company versus the big bad MS. Who is Latch gonna root for?
I'll bet on the Canadian company. I suspect the merits of the case have nothing to do with this. And for anyone who has never read "A Civil Action" let me tell you the merits of the case will have little to do with the ultimate outcome. Civil courts (including the Supreme Court) are about process and not justice. |

#2: That would be nice but then there's the argument that they should not be setting new law, which is up to Congress (and good luck with THAT.) That's why I guessed that I would see the worst of both worlds: MS ducks the whammy by a prior art ruling that invalidates the i4i patent but the crappy patent law remains untouched.
#3: I'm not nationalistic; I don't care if i4i is Canadian or not. MS has been on the patent offensive for years, so to me it smacks of hypocrisy for them to go running to the Supremes now that they lost a biggie. That being said, I would rather see MS win on this if it meant that there was something substantial being done to reform the broken patent system. I don't have much hope that it will go that way. |

| I'm sure if there's any legislation to be made this Supreme Court will gladly do it. |
