'Sidekick' owners sue Microsoft over cell data wipeout | |

They lost song lyrics, phone numbers and e-mails -- all stored on their Sidekick phones -- and now several Chicago area residents are suing software giant Microsoft Inc. and subsidiary Danger Inc. for a server backup problem that caused the wipeout. The four plaintiffs named in the suit have yet to recover the data from the October incident, according to the lawsuit filed in Cook County Circuit Court. The "data debacle," as the suit calls it, happened Oct. 2. | ||

| Over $70,000 per person for lost data? Insane. Even though this is a service issue, this ongoing legal BS is one reason that companies shifted manufacturing to outside of the US. Too many lawsuits. Say I stubbed my toe after I kicked a fork truck parked in a brightly lit, well marked area, that I did not belong in. There was no sign that read " Do Not Kick Fork Trucks". I sue you. Doesn't matter if it appears to be frivolous or not. Your business needs to spend money that would have gone to some other more productive use than legal fees. Even a "quick" summary judgement cost money. |

Would love to see the text of the service agreement that goes along with the service.
And I'd highly doubt MS "specifically instructed that a backup of customer sidekick data not be made while working on the upgrade." Will be interesting to watch but you have to think the service agreement addresses outages and loss of data. |
