Vista Capable suit no longer a class action | |

The judge overseeing the “Vista Capable” suit against Microsoft has removed the “class-action” designation from it, but also declined Microsoft’s motion for summary judgment. The latest court action on February 18, resulted in Judge Marsha Pechman reversing her original decision to allow the case class-action status. Pechman did note that individual plaintiffs will be allowed to continue legal proceedings if they can prove harm. | ||

| well... ther ya go... proves that Judges still interested in justice reason that people can read, or at least should be able to read - especially if they are buying a personal computer. I'm not surprised that the judged allowed individuals to go forward - provided the can prove "harm" which is doubtful. |

| Lloyd, I don't think the real issue was if people read and comprehended what Vista Capable meant. The issue, not addressed in the suit, is that the sales people that interfaced with the public often didn't know what Vista Capable meant, or gave their personal interpretation in an effort to appear knowledgeable. Lawyers won't sue salespeople that make $9 per hour. It's too easy to go after MS hoping for a quick settlement. |

Agreed.. sadly... it was so "sad" that if you recall, Microsoft provided animated cartoons featuring lego like characters to clearly and sssssslllllooooooowwwwlllllllly explain each facet of the program.
They went so far as to release the training cartoons in segments over time - so as not to overwhelm the students - retail sales associates in the channel. While clever and colorful, the toons were so juvenile, I found it hard to believe that any sales associate with a fourth grade reading level would not be insulted. Regardless, it was determined that such basic training was necessary - and quite possibly, this nutty legal case proves why... these toons were featured by the defense, by the way, and link from this website well before the business launch in 06. |

Cartoons? Where were the cartoons when the cheats and liars that are now sticking us with trillions of dollars in government debt were buying homes that they couldn't afford and didn't have the money to pay for?
Where are the judges like Pechman to say no? Instead we have the "queen" of finance, Barny Frank running our banking system. Our government schools taught by union workers that refuse to be tested as to their adequacy to teach at grade level is working! Now, class (this is a kindergarten class at a government school) today we are going to learn how to put a condom on a banana. You will need this in about 15 years. So, pay attention! |

#4, JD, that could not have been expressed any better.
I feel like I am watching a very bad episode of the Twilight Zone. To hand all of us that have been so conservative and responsible the tab for out of control spending by people, governments and institutions is inexcusable. |
