Because they have far more problems and complaints than AOL or Earthlink, and far more customers--remember they're addressing passport which means HotMail first and foremost, MSN, and a host of other ways to come into customers. And #4 is right, MS has the worst incidents of spam, and this is what EPIC is talking about. They aren't talking about eavesdropping; they're talking about spam, overexposure to fraud (crappy deals from fly by night co's), and greater risk of secure, private info being exposed.
As for other industries selling credit info, it's America that's at fault for that; we pride ourselves on our marketing DBs, and it is completely legal to do this. Also selling marketing info has been around so long (it predates electronically or technologically stored data), I don't think that would be on the radar of EPIC.
