Apple: Microsoft should pay $1 billion--cash | |

Apple Computer CEO Steve Jobs said Thursday that Microsoft should give $1 billion in cash to help schools, instead of software and some money, to settle more than 100 consumer lawsuits. Jobs' statement came one day before Apple plans to file a supplemental legal brief further contesting the legitimacy of the proposed settlement of the suits. Microsoft and attorneys working the cases, which are consolidated in a Baltimore federal court, cut the controversial deal in late November. Attorneys for Microsoft and the plaintiffs are set to return to court Monday to complete a hearing before U.S. District Judge J. Frederick Motz. "We think a far better settlement is for Microsoft to give their proposed $1 billion--in cash--to an independent foundation, which will provide our most needy schools with the computer technology of their choice," Jobs said in the statement. | ||

Though I can't stand Steve Jobs (but have no ill feelings towards Apple), I have to agree with him.
Microsoft should not be alowed to 'punish' their way into yet another monopoly with this agreement. The Money should be given to the schools so they can buy the equipment and software that THEY want to buy, not what Microsoft feels will help Microsoft. Yes, they may get upset that some of the money may be spent on Apple and other non-Microsoft products, but that's tough. It's a punishment, not a reward... TL |

Paying back the people who filed the lawsuits?
I'm sure the lawyers would agree. After all this is yet another example of a lawsuit that has nothing to do with consumers. |

That's funny because it's not true. Filed on "behalf of consumers"? Um, right. It was Microsoft's COMPETITORS not consumers that got the DOJ after Microsoft. So called "consumer groups" only chimed in well after the case had begun. Considering the class action suit currently underway is by the states, and the states run the public school system, that seems to work out just fine. I do, however, agree that a $$$ solution ... er... punishment is better than a technological one. While I think the technology would help the schools *more* than the money, it would simply not be a punishment for Microsoft, it would be almost a reward. |

#22 - Ask yourself this: If *competitors* hadn't tried to kill Microsoft using the Government as their weapon, would "consumers" have filed the class action suit?
In other words, were "consumers" (wow, that's a misleading term) outraged by Microsoft all along, or did they see this as an opportunity to skirt around the traditional means of capitalism to get what they want? Let's face it, the VAST majority of consumers are people who buy a computer with the OS pre-installed. The price of computers has falling steadily for years and years. Computers have never been cheaper than they are today. I know of nobody who complains about the "hidden" costs of Windows when they buy their $899 PC from Dell. |

The sad part about all the arguments is that everyone believes that these lawsuites are filed on behalf of consumers.
There are two things to consider: 1. This is political. I'm not going to go into much with this but if you think that the Prosecutors are doing this on behalf of the people in their states I would advise them to take a poll. Who wants it and who doesn't. My guess is a couple of jackasses wrote some letters and the prosecutor saw a way to get into the limelight. 2. Americans will sue for almost anything if they think they can win. Its sad but here in the good ole US of A we can sue for whatever reason we like and unless its completely unfounded it will go to court and cost the person getting filed against alot of money just to prove they are innocent. I personally don't think that MS charges too much for their software. Does it suck when I want to upgrade the Computers in my company to the next version and pay for all those licenses. Your damn straight. But that is life. If you pay 200 or 300 dollars (Home, Prof) for an OS and another 300 for the office program you have to ask yourself will this product a profitable amount of work out of the people using it. In most cases yes. Even if you just get the OS for someone to use EMail it is going to help out. Hell if you want you can use wordpad to do all of your word processing... it ain't that bad :). Point is. If you look at the cost of a computer 5 years ago the OS was a large part of the investment. Now you buy a $1000 computer and you get Windows XP Home, P4, 128MB RAM. Shit that's a good deal. People will always want things cheaper no matter what the cost (*cough* linux) I just highly doubt that there is a scientific way to find out if MS charges too much and I'd be willing to bet that the people involved in the lawsuit are all running MS software which should be enough to close this case. Excersize (spell check) your right to lower prices by not buying something. This shit just makes me sick because it is taking up peoples time and money that could be spent fixing more pressing problems with our nation. |
