Apple Computer has been slapped with a lawsuit by Tiger Direct Inc. for allegedly infringing its trademark with the new Mac OS X "Tiger'' operating system scheduled for release on Friday. Tiger Direct, which sells computers and related products on the Internet, said Appke's Tiger OS threatens to dilute its trademarked name, according to Bloomberg, which has obtained a copy of the lawsuit. | ||

They have no case, just like MS had no case against Lindows.

Isn't Tiger just a code-name anyway? Trademark laws are not applied to internal code-names.
Not to mention the fact that not even the dumbest of people would be fooled into thinking that the two were related in the slightest bit. |

Apple has been using its codenames as retail product names since at least the release before "Tiger". The one before "Tiger" used "Panther" as its codename and marketing name. I'd hope that they'd check for TM issues before using it though technically I think the product is referred to as MacOS X Tiger officially and just Tiger unofficially.
I agree that it seems Tiger Direct's case is slim. To my knowledge they produce no software, and it seems remote that the OS would be confused as being their property or associated with them beyond being a product that they sell in their Mac department. IANAL though. |

| Some of the marketing does only refer to it as Tiger, not MacOS X Tiger ( http://www.apple.com/ ) however I'm still not sure Tiger Direct has much of a claim. |

So they wait until the week of the Launch to do this.
It's not like the name "Tiger" hasn't been known for nearly 2 years? I guess they think they own the big Feline's as well. Pathetic... |

| Honestly, having done some business with Tiger Direct... I don't think their brand can be damaged any further. |
