California cities, counties lose Microsoft suit | |

A federal judge yesterday dismissed a lawsuit filed last August by several California cities and counties accusing Microsoft Corp. of overcharging for its products. In the class-action case, the cities and counties accused Microsoft of unfair anticompetitive behavior and unfair business practices in violation of California law. The governmental entities sought monetary damages. U.S. District Judge Frederick Motz of the U.S. District Court for the District of Maryland granted a motion by Microsoft for dismissal of the lawsuit. Motz dismissed the case because government agencies can't sue under one of the laws they invoked and because they were seeking damages over too broad a time period, according to the judge's opinion. "Today's decision granting Microsoft's motion to dismiss is welcome news," said Microsoft spokeswoman Stacy Drake in a statement sent via e-mail. | ||

Soda - How is a ruling based on existing US law being an activist judge? It's not like he looked to EU law/opinion to make the ruling..
The ruling seems to make a lot of sense in this case. I'm not sure that the end result is going to be in favor of CA though, Didn't they already sue MS for this a couple of years ago? |

happyguy - Activist Judge means someone who makes a ruling you disagree with.
At least that appears to be the definition according to what Reichsleiter DeLay has said in public. |

DeLay's comments were related to the use of INTERNATIONAL law and "internet browsing". What kind of judge does that? An ACTIVIST judge. A Supreme Court judge should rule based on AMERICAN laws and based on the case presented to him/her... not based on the links that google happens to find.
