Video game maker sues Microsoft | |

Video game maker Mythic Entertainment has filed a lawsuit against Microsoft, charging the software giant with trademark infringement and unfair competition. Mythic, which specializes in multiplayer online games, contends that an upcoming video game from Microsoft dubbed "Mythica" infringes on its name and trademarks. The company said on Monday that a prerelease of and marketing materials for the Microsoft game, designed to be played over the Internet, violate its established brands under state and federal laws. In the suit, filed in the U.S. District Court for the Eastern District of Virginia, Mythic contends that the title of the Microsoft game is likely to cause confusion among consumers. The Washington, D.C.-based company said it is seeking a permanent injunction against Microsoft to prevent it using the name and is asking for related financial damages, including legal fees. | ||

What percentage of buyers actually pay that much attention to developers or care? I can't tell you one game that Mythic has made. |

| knapier, hmm, can you show a single example of a price increase for Windows? The price has pretty much remained the same from the beginning. Volume and special agreements change from time to time, but the base price hasn't. |

If there is confusion, it would mean people would have to already know about the game company called Mythica firstly, and since we are talking about 'confusion' that clearly says to me that it would be around people confusing the MS game for something made by Mythica, surely that would give Mythica some free publicity at the end of the day so what are they whinging about??????
Well just another case of lets jump on the "Sue MS" bandwagon, everybody is getting sick of it Im sure. |

Hmm, one of my computers is named mythic. I should probably sue, as they obviously stole my theme of naming things with words ending in 'ic'.
Actually stubear raises a good point. Microsoft owns Bungie. Bungie made Myth. Myth was a 3D tactical warfare game based on Norse characters. Myth came out in like 1997. Age of Camelot and Mythic have only been around since 2001. Mythica is a multiplayer world based on the Myth game. This lawsuit is bizarrely frivolous. |

| #8 You don't need to be a lawyer to have an opinion about something or to still know a bit about the law. For example, unlike what stubear said I don't see any problems with "Lindows", even though it apparently is similar to "Microsoft Windows(tm)" (note that it's "Microsoft Windows(tm)" and not "Windows(tm)". "Windows" should not be trademarked, else I want "Doors", "Cabinets" and "Floors" trademarked as well! However "Microsoft Windows" can be. Note being a lawyer doesn't stop any of us from putting forward our 2cents on the issue =) |
