The states that settled with Microsoft accepted the proposal. The nine states that were left (those who did not settle) are the ones that may appeal the case.
Without going apeshit here, simply put, I can't imagine how they can justify an appeal. Not to mention the fact that if this went to the appellate court, I highly doubt they'd even take the case as they have the right to throw it out.
With the current state of the economy and the ever increasing pressure from tax paying citizens in those states, it would appear at least to me that most states are going to take what they've gotten (nothing) and go home with their tail between their legs.
There is no more case left. The government is done with it, the judge approved the settlement, the appellate court threw out the breakup order and plenty of other nonsense by Judge Pinhead, and more than half the states have settled. We'll just see what happens...
Microsoft will be embroiled in legal issues like this for the rest of the company's life. They've got the cash and legal staff to deal with it. They are the healthiest company in the world without a doubt... with that in mind we all know they'll be just fine. :) Keep in mind the effects of IBM's antitrust case years ago... they are still fighting off small lawsuits all over the place. Its the way it goes once you have a target painted on your forehead like Gates does, especially by Scott McWiner.
Without getting off on that tangent (Sun sucks), I would like to post a quote from Sun's CFO that I found hysterical from the company that claims to be the end all and be all of networked computing:
"In October, Sun stated that it had two overriding financial objectives: to remain 'cash-flow positive' and to 'return to long-term profitability,' McGowan said."
That's a good idea McGowan! Keep up the hard work you close minded goofs.
