U.S. Wants Microsoft Case Back in Trial Court | |

The U.S. Department of Justice (news - web sites) (DOJ) contends that the federal appellate court handling the Microsoft (Nasdaq: MSFT - news) antitrust case should not allow the Redmond, Washington-based software giant to stall any longer on the case's outcome, arguing that the Supreme Court justices would most likely agree with the recent appellate court opinion and, therefore, not elect to hear the case. In a brief filed Friday, assistant attorney general Charles A. James said that granting Microsoft's recent request for a stay pending consideration of the petition for Supreme Court review would only "further delay the public's remedy and contribute to uncertainty in the market," and that Microsoft has failed to meet any of the requirements for a stay. | ||
