#2: Security for the group as a whole is greater when more members of the group are immune. For example, a pirate that's protected from a malware strain will not be likely to pass it on to legit users who may not have any malware solution installed.

"Pirates" usually run a patched OS that shows up as "genuine", so this headline is a bit misleading.

Latch, I understand the concept of group immunity (more for people than machines), but even so there are dozens of free alternatives. Why would MS give this away to pirates?

while software pirates should never be rewarded, neither should responsible and law abiding users of software be punished.
In a larger sense, Microsoft manufactures the software, a product and they have the responsibility to make as safe to use as possible. For this reason components like MSE should be part of the operating system and included without risk of anti-trust legislation being brought against them. To block this would be as ridiculous as it would be to prevent a car company from putting better bumpers on their cars, or forcing them to remove seat belts.
Finally, I think that the security companies have profited enough, long enough from the suffering of others. If they are required to do something else, fine. We no longer have many buggy whip factories.

#5: While we in the West tend to think of pirates in terms of tech-savvy IT people, I believe the reality is far different. Lots of people from other countries run pirated Windows on their systems and they barely know their ass from a hole in the ground. They aren't likely to go out looking for anti-virus and anti-malware software. If MSE comes to them via Windows Update (assuming their system is set to auto), then they have at least a small chance of not being part of a botnet.

#7, I actually agree with the notion that most pirates are just people - regular people and from developing countries. However, there are two exceptions: 1) criminal organizations providing pirated software and sadly, 2) disc loaders in developed countries.
Those is groups 1) and 2) need to be prosecuted and shut down.

#8: "Feet on the street" is the only way to catch groups 1 & 2. MS can't distinguish between different user types and it should not restrict security measures to legit users only.

I have to agree with those that thing this is a mistake on MS's part.
If you going to give away the product, give away the product, trying to block it for supposed pirated versions (which they have still don't have perfected, and probably never will, though they've gotten better), is shooting yourself in the foot. Besides those dedicated pirates are already using some other antivirus or have correctly mod'd the software to report clean to MS.
In the end here microsoft is just giving themselves a bigger head ache and bad pr long term.
If I'm ms and I have to decide between keep this tool aware from a majority of potential customers who probably don't even know they have pirated software, keeping millions of systems branded "windows" vulnerable for the next wave of malware, or giving away a couple million copies of something that's already being paid for by legit customers, to illegit ones to help protect my brand image and my actual customers in return it's a no brainier, I choose the later.
Don't know what fool at MS really thinks this is some how a good idea.
