Microsoft, U.S. Refine Antitrust Settlement | |

Microsoft Corp and the U.S. Justice Department said on Thursday they had agreed to modify their antitrust settlement to address criticism that it contained loopholes. In legal briefs filed with U.S. District Judge Colleen Kollar-Kotelly late Wednesday night, both sides described the changes as refinements. "The modifications announced today simply make this effective settlement even better," said Charles James, the department's antitrust chief. The department filed the changes as part of a 239-page brief defending the settlement deal and responding to public comments submitted earlier this year. | ||

I heard a funny joke the other day...
If Bill Gates announced today that he had discovered how to walk on water, Microsoft's competitors would come out and claim that was only because he didn't know how to swim. Anyway, changes to the settlement look good. |

| I think the "competitors" would just sue for the water-walking technology even though Bill did all the R & D. |

| I think that since Bob won't post my news submission, I thought you'd all like to know that Microsoft is also threatening K-K now for supervening the executive branches right to dictate policy. They actually try to suggest that if K-K were to overturn this for whatever reason, it would be a matter of the judicial usurping power from the executive branch--after all, she is supposed to only act in a "ministerial" capacity. Again, the DOJ, that is the executive branch, does not support, voice, or agree with this insane opinion of the walk-on-water Microsoft. |

| First, what is your source sodajerk? Second, why is that a threat? It doesn't sound any more of a threat than the famous "We'll appeal" which is heard after just about evey verdict in every court. |

| Bob, my source is the Microsoft document. It is a threat because it is a repetition of the Sporkin scenario. It is a threat and not an appeal because it precedes any action taken by her--they are trying to tell her her place before she does anything. Generally, an appeal comes after a judicial action and not before. And because I think it's a ridiculous claim without legal standing, and a claim not supported by the DOJ, that makes it a softball lobbed in the air--only meant to influence her decision, not to provide guidance under the law. |
