A U.S. Appeals Court on Wednesday upheld Microsoft's landmark antitrust settlement with the Department of Justice and several state attorneys general, rejecting Massachusetts' appeal for stiffer penalties. "The order approving the consent decree in the public interest is affirmed," the appeals court wrote in an 83-page ruling that preserves the settlement and dismisses the objections of Massachusetts--the lone holdout state--and two industry trade groups. A representative for the Massachusetts Attorney General declined to comment, saying the agency would issue a statement by e-mail later Wednesday. Microsoft was preparing a statement as well. | ||

jpursell - How is a court decision upholding a settlement and knocking down a plaintiffs appeal proof that we need tort reform?
This just seems like a rather stupid and illogical statement, because most thinking persons would look at this and notice that the justice system worked as designed. Maybe I haven't thought through all the angles, however, and I'm open to arguments. |

That reason is almost as popular as not voting because you might then be called for jury duty. I know two guys that don't vote for that very reason. They are both liberals, so I make sure and mention every so often just how bad jury duty was when I was on it. :-) |

GhostRider - Yeah, I'd agree the statement is clearly political rhetoric designed to confuse the issue.
jpursell - I guess I'm just not seeing it. The issue we are talking about here was an appeal against the settlement. Mass was saying that the settlement didn't do enough and they wanted stiffer penalties. Money, or desire for on behalf of the state or any plaintiffs was not a factor in this case. Frankly, I think mass was wrong, but I also believe that it was perfectly reasonable to file this case if they believed the penalty was wrong. They were given an opportunity to argue their case, and the judge decided against. It appears that I have a lot more faith in America's government institutions than some people, apparently, and I see this case as proof the system works. Maybe I just love my country more. |

We'll very likely see this after November when Bush loses. We're already seeing a major split in the Republican party over this Abu Ghraib thing, as well as the fiscal mess Bush has created with the Federal budget. One side is going to end up pushing the other side out the airlock, and you'll see a third party likely form from that. |

"when Bush loses" Didn't you make that same prediction in 2000? So, you have a sad track record. I think maybe you don't have a clue either. |
