#8 I doubt it, you may see some large enterprises signup for renewals on the SA program due to this, but this won't affect 9/10ths of the companies out there.
#9 There are ways around this (as I've posted before). Boot from SAN (supportable in Win2K3), replicate the changes across the network to another SAN (DR facility). Upon failure you just rezone the LUNs on the SAN for the new server to boot from that particular volume. Voila! A DC that is not out of date and you have only had to use 1 Win2K3 license.
Aside from that, You shouldn't be housing all of your DCs in the same facility anyway.
