Microsoft has suffered another legal setback in the patent dispute with software developer Eolas and is now advising Web authors on workarounds, as new details emerge of its plans to tweak Internet Explorer. A federal judge last week rejected Microsoft's post-trial claim that Eolas had misrepresented the facts in the patent case, which claimed the software giant had stolen browser technology relating to plug-ins. The ruling came after a $521 million verdict against the software giant last month, and ends Microsoft's first attempt to challenge the result. | ||

| Maybe Eolas doesn't want to be bought or wouldn't be worth the asking price just for a patent or two. |

| Besides, it wouldn't be good for MS to start buying everyone that sues them rather than defending the suit. Companies would start suing them just for the possibility of a buyout kinda like how some sue them now just for the possibility of a payout. |

MS didn't buy any of their plaintiffs in the DOJ case though I'm sure many wish they had. Look at the transcripts to see why MS got the settlement they did. There were some parts they could have argued further in their favor, but they chose not too.
When they got rid of the biased judge and Kotelly came in, the case was finally weighed on the evidence presented (or severe lack therof) instead of false preconclusions and suppositions thrown around as facts. Look at the transcript from MS' appeal which terminated the injunction against distributing Windows without Java and you'll see mainly supposition in it as well on the part of Sun. Many of the transcripts are quite funny when covering discussions between the attorneys and the judge(s). MS has had many suits of varying merit brought against them and I don't remember them buying anyone because of a suit. That has been an AOL tactic however (see Mirabilis - maker of ICQ).
