Lester Warby is the kind of guy who reads the fine print. And the fine print for the latest updates to Microsoft Windows has him worried. Warby -- who is the chief information officer at Seattle Metropolitan Credit Union -- believes that the terms for the end user license agreement (EULA) for Microsoft's Windows 2000 Service Pack 3 (SP3) and XP Service Pack 1, might well put the credit union in violation of new federal privacy laws. | ||

People in the media need to contact lawyers and verify their claims before writing crap like this.

I thought it was pretty clear.
MS needs to know what OS you're running and what components and MS software you have installed and what versions so they know what updates you need. It's pretty cut and dry and verifiable. By "software information" (the term in question here), they mean "information about your software", or "names, versions, and required DLLs for the software you have installed". MS is very explicit that they do NOT TRANSMIT any data to MS during the procedure. It's a client-side ActiveX object that inspects software versions. MS has been very careful to make sure that nothing is transmitted and only the required information is inspected because privacy hounds watch MS like hawks. I think this is just a case of sensationalistic journalism again. |

| Actually AU is on by default (which helps for those that don't normally check WU), but you are notified to set the update behavior before it first runs. |

| When I'm rich and famous, I think I'll form a consumer advocacy group to sue foolish "news sources" for liable. A lawyer who can read and an admin who is worth his salary doesn't have problems with SP 3. Knaves, however, are in a rather different category. |

what seems to be overlooked by most law makers is that there needs to be a consumer protection bill for software practices. Spyware, spam, auto updating and EULAs need to have guide lines. the average PC user does not understand any of this. they need something like the FDA seal of appoval, where they know that it has some legitimacy behind it. look at auto updating: all that really has to happen is the vendors software tells your PC what version it has of the software on your PC. thats it. if its newer then you download it. what else really has to be sent?? the only thing needed from the users PC is some very basic info like "i have Office XP SP1, what do you have?"
that needs to be the law for every company out there so that these uninformed technophobes can trust start trusting the technology. same with Spyware- all spyware MUST clearly state what info is sent from and to your PC. A mandatory privacy statement stating flat out that NO personel data is collected, sold or shared with out the user giving explicit consent should be law. However generic, unpersonel usage statistics is fine (although the user still needs to be told that there is something being sent from there PC) |

You get a point for that, blue. That really made me laugh.
kev, you say we need another government agency? I can't think about how horrible that could be. Before you could release a software product, you'd have to offer it to the FSA (Federal Software Administration) for approval to sell it. I think what would be a good idea is if non profit groups rated software. We have ratings for movies, games, music. We have TrustE for web sites. We have Good Housekeeping for, well I they have a seal of approval, I know they do something. We have Consumer Reports. We have the BBB. Let a NPO or even a regular corporation not regulate, but inform consumers what products are all about. If the organization proves itself unbiased, then consumers will begin to be very interested in what it says. As more consumers are interested in what it says, more software vendors will allow its software to be certified, thus creating a positive feedback cycle. |

z00ker - Agreed. OS/2 was slightly better than Win95. Unfortunately it had a really horrible user interface, and was extremely difficult to maintain.
I do hope I never see OS/2 again as long as I live. |
