Sometimes real life is stranger than any video game. When Swedish computer game designer MindArk, maker of the controversial Project Entropia role-playing world, announced Thursday that Microsoft was behind the raid of its corporate offices, the claim sounded like a Gates-hater's most paranoid delusion. But it turns out this is no fantasy. At the request of Microsoft, Adobe Systems, other members of the Business Software Alliance (BSA) and nearly 70 local court officials in Gothenburg, Sweden, swept through MindArk's offices, temporarily shutting down company operations while the bailiffs catalogued every piece of software in the place. | ||

#2 - Well, Microsoft would almost certainly pass the test with flying colors for two reasons:
1.) The majority of the software they use, they also wrote. 2.) They have GOBS AND GOBS AND GOBS of money, which makes purchasing software kind of a no-brainer considering the potential damages they would incur if they were caught pirating. Anyway... seems to me this company is a bunch of scum bags. Granted, I'm going off only what I've read during the past couple of days, but they seems to scam people out of their money, in addition to pirating software. Now they're using this whole thing as a big PR stunt because so many people hate Microsoft and would love to think they're just "flexin' their monopoly muscle" again. |

I'm just going by what you told us. You're right, I DONT KNOW what is on you machine. I just hope you know what an MSDN subscription is. It means you are DEVELOPING for those technologies. A subscription doesn't necessarily give you the right to use the subscription to get your OS on your primary desktop, etc.

ANSWER: By "production" we mean any activity that is personal, for general business use, or not directly related to the testing and development of software applications. YOU MAY NOT USE YOUR MSDN SUBSCRIPTION AS A SUBSTITUTE FOR PURCHASING A RETAIL LICENSE FOR AN OPERATING SYSTEM IF YOU DO MORE THAN DEVELOP AND TEST ON YOUR COMPUTER. Therefore, if you are replying to my ActiveWin post using the computer with the OS (from MSDN) then as I said earlier... YOU ARE A THIEF. Have fun with that one, bloke! |

If I'm not mistaken, mooresa56, it is NOT in violation of the MSDN subscription licensing agreement to use certain certain apps for business use.
From Section 5.1 of the Master EULA.... With respect to those COMPONENTS designated as Applications, Microsoft grants you, as an individual, a personal, nonexclusive license to use such Applications for business purposes, provided that such business purposes relate specifically to your design, development, testing and demonstration of your software product(s). In addition, solely with respect to the Microsoft Office COMPONENT, Microsoft further grants you, as an individual, a personal, nonexclusive license to make, use, and install one additional copy of Microsoft Office on a single computer for general business purposes provided that you are the only individual using such copy of Microsoft Office. Correct Bob. My last post did include a link to the info you quoted. In the FAQ, under the question I quoted...

Software in your MSDN Subscription comes with a development, test, and demonstration license. Examples of prohibited use include: You may not install BackOffice Server (or just Exchange Server) from your MSDN Universal Subscription and use it to send and receive personal or business-related e-mail. You may not install Windows NT Server and use it to host your own personal or business Web site. The one exception is that the MSDN Universal Subscription comes with one license to use Microsoft Office for general business use. Again, only persons with an MSDN Universal Subscription license can use the Microsoft Office software in this manner. |

Moozilla was not talking about servers. He was talking about a desktop (or laptop). So the "Desktop Test System" (referred to in my post) is the applicable portion of the EULA. In other words, I think if he is using his machine to develop software and also uses it to to do business (especially business related to developing software) then there is not licensing issue.
Also, I might add, you are quoting from a FAQ. A faq is not legally binding. I am quoting from the EULA which is legally binding. I have heard first hand Microsoft employees say that you should buy MSDN subscriptions for all your development employees and not purchase any other licenses. Their advice (which is contrary to the both the FAQ and the EULA) is not legally binding. Their advice extended to using the subscription to cover 'business use' of an internal SQL Server. |

LOL. BobSmith, THIS is the guy you are taking up for? His last post includes the same sentiment I noticed and "jumped on" with my first post... when he said,
"My personal view on my software is I will pay for it if I am making money from it as in a living but I am not so I dont." and then later with "EULAs can be skipped over :D its called a click thru script" Quite frankly, he seems overly excited by the whole concept of stealing software. Call me judgemental, but I'm betting he's stealing. Bob, I can't seem to find "Desktop Test System" in your original post. |
