MS probably needed to make sure they had their legal ducks in a row. These fake antivirus programs usually come with license agreements that stupid users blindly accept. Once accepted, that's a contract between the user and the malicious company. For a third party like MS to come along and delete the program is a potential legal liability. Even though common sense tells you that MS would be in the right, MS is a company with lots of money. Companies with lots of money get sued somewhere for something every week, no matter what they do.
Haven't you ever heard of a burglar who gets shot by a homeowner, then the burglar sues the homeowner and wins? It's called working the system. It doesn't always work, of course, but who's got more to lose? Not the low-life burglar or his weasel lawyer. That's why Symantec was forced to go to court against Hotbar.com in June 2005, and why all the real security vendors have to walk a fine line with these jerks. It's easy to delete malware which sneaks onto a user's system 100% silently, but if the malware clearly displayed a EULA which brazenly states that the user agrees to surrender total control of his system, and the user clicked Accept without reading any of it (as usual), then someone like MS needs to spend the time to assemble lots of documentation proving that the fake program was so deliberately and consistently fraudulent that the EULA cannot be enforced. |

I have an idea. A law stating that...
For a EULA to be legally binding, the user has to either speak every word of it into a Mic, or type every word of it, this indicating they actually read it. That would pretty much end EULA's :) That's my master plan to get rid of them :) Mwahahahahahaha TL |
