Microsoft Trial Expert Paid Economics Consultant for Co. | |

Microsoft Corp's economic expert in its antitrust remedy trial has been a paid consultant for the company for four to five years.And all his research on the software industry since the 1998 case began has been paid for at least in part by Microsoft. Those facts about economist Kevin Murphy were revealed in questioning Wednesday by an attorney for nine states pursuing the case in federal court. Murphy, aeconomist, is the second witness called by Microsoft in its defense. Under questioning by attorney Steven Kuney, Murphy acknowledged that he had published no articles on the economics of the software industry prior to 1998. Instead, the primary thrust of his research had been labor economics. | ||

All witnesses brought for the prosecution or defense are paid for their time.
Defense lawyers frequently call up "Rent-a-doctors" to testify on their behalf and will say just about anything you ask them to for a price. |

| CPU, the best way to look at it would be: if you have 2 economists who say exactly opposite things--do you believe the guy with a lot of experience with the software industry, no connection to either side, and very little profit motive-- or -- the guy who never wrote on or discussed the software industry until he was hired by MS, who since then has only written pro-MS materials all of which were in part or fully funded by MS? |

So, MS hires this guy's Firm to figure out the economic impact of what the States are proposing, and then he testifies his findings in court and somehow this is wrong?
What am I missing? |

| #12, everyone puts a witness that is close to them on the stand. It is no diferent than putting the county coroner on the stand in a murder case. The coroner still works for the county and is paid by them. If the man is giving an opinion based on the facts it makes no diference as long as the court knows who the guy works for and who may have contracted him to do work for them. It will only strengthen or weaken the witness' credibility in the case. And I don't think we need to be calling anyone stupid to get your point accross! |

#12 - Anybody who is pretending to be shocked that the testimony in this case has conflict of interest issues is pretty damn stupid. This whole case has been a sham since the beginning. |

| #15 what is the point? If the guy did not have anything to do with software, then MS wasted the courts time and the judge will take note of it. If the man had nothing to do with the case at hand the judge will also take note of that. It will only hurt MS, so if they want to sabatoge there own trial, let them. It is really a moot point, if they want to shoot themselves in the foot then so be it. |
