Judge rejects Google's anti-Microsoft antitrust bid | |

A federal judge refused on Tuesday to rule on a last-minute Google antitrust complaint about Windows Vista's desktop search, saying she trusted government attorneys who said they were already satisfied with Microsoft's planned changes. U.S. District Judge Colleen Kollar-Kotelly said she would rely on the U.S. Department of Justice and state attorneys to alert her if any further action is needed to address antitrust allegations lodged on Monday by Google that the search function still won't allow for adequate "user choice." "The plaintiffs, as far as I'm concerned, stand in the shoes of the consumer," Kollar-Kotelly said at a periodic status conference here. She added that Google "is not a party to the case." | ||

| Woot! Go Judge Kollar-Kotelly - not because of the decision itself, but for doing what judges are supposed to do - follow the law. The ruling is the only ruling which could have been made [and survive any form of appeal]. |

is Judge Kollar-Kotelly the only judge that works on microsoft cases? Or does she just draw the short straw alot?

#3 - she took over from Judge Thomas Penfield Jackson who was found by the court of appeals (CoA) to have committed serious improprietes while overseeing the Microsoft case (e.g. giving interviews, comparing Bill Gates to a drug trafficker, etc). When the CoA had made their ruling, they remanded it back to the district court, to Kollar-Kotelly, and she oversaw & approved the settlement and is the one responsible overseeing the adherance to the terms of the settlement.
On the other hand, other suits (class actions, antitrust suits brought by other companies, etc.) go to different judges. |

| While I firmly believe MS' feet should be held to the fire on their compliance with the antitrust decree, Google had no standing here. I just wish I had as much faith in the DoJ as da judge does, considering one of the top DoJ guys is a former MS lawyer. |
