Microsoft's Jason Matusow is a man who knows his way around both licensing and interoperability standards. Formerly the head of Microsoft's Shared Source initiative, Matusow now helps lead Microsoft's standards efforts to make good on its promise of interoperability by design. But there is that pesky problem of patents, that Microsoft alleges certain Linux and open source code may be infringing upon. "We think software intellectual property [IP] is critically important and has a great deal of value, but we want it to be quality IP and not just something to block other people from doing stuff," Matusow told internetnews.com. Things like FAT32 and NTFS..
"Oh, you can read and write FAT32, well thats our IP and you need to pay a license.. Oh you can read NTFS, well that too is our IP and you need a license for that too.." This is what all the FUD is about.. Never mind that it was reverse-engineered and has not one bit of original MS code in it.. It's about being able to say we did it first, we patented it, so pay up.. Just like the stupid patent of displaying a GUI desktop with Windows; even though the name isn't windows. Most GUI's have this.. I think MS has this patent too.. Gotta pay, it's their IP.. |

| #1: I believe the patent on the GUI window is owned by Apple, Inc. They also own the patent on the scrollbar, buttons, and all sorts of other GUI elements. They also own the patent on the mouse. This illustrates another key problem with the patent system as it applies to software. You don't actually have to invent something. You only have to describe and patent it first. Much of the original GUI ideas patented by Apple were originally invented by Xerox at the famous Palo-Alto Research Center (PARC). Apple then stole the ideas from them, and Microsoft stole them from Apple, after seeing it on a Mac. However, it should be mentioned that when Apple / SJ took the ideas from Xerox, Xerox did NOT have any of that stuff patented. It is only the patenting of ideas others created that I am commenting on here, pointing out that this is another problem with the patenting of ideas. |
