Longtime software antagonists Microsoft Corp. and Novell Inc. have reached a technological truce that promises to smooth the way the still-dominant Windows operating system and the increasingly popular open-source Linux system work together. The agreement announced Thursday between the world's largest seller of patent-protected software and a leader in the open-source software movement has potentially important business, technical and legal implications. | ||

| Novell has sold its soul. And, as Pamela over at Groklaw said, nobody ever seems to remember what happens after MS' "Embrace". Ask IBM, ask Sendo, ask Burst, ask Netscape, ask STAC etc etc etc |

"A LEAD DEVELOPER on the Open Source Wine project, Tom Wickline, has warned that Microsoft's deal with Novell is a cunning plan by Vole to take control over the commercial customer's use of Free Software. Speaking to the INQ, Wickline said that the Volnovo pact would have significant negative implications for the Open Source movement. The crux of the deal, to Wickline, is the fact that Microsoft is promising not to assert its patents against individual non-commercial developers. Wickline said that the pact means that there will now be a Microsoft-blessed path for such people to make use of Open Source. It also sets the stage for Vole to assert its patents against all commercial Open Sourcers who are not part of the Volnovo pact. The Volnovo pact will mean that non-commercial individual contributors can make Open Source, but if anyone actually uses it for something other than a hobby or a non-profit organisation Vole can bring a software patent lawsuit against them unless they are a Novell customer, he said. "A logical next move for Microsoft could be to crack down on "unlicensed Linux" and "unlicensed Free Software," now that it can tell the courts that there is a Microsoft-licensed path. Or they can just passively let that threat stay there as a deterrent to anyone who would use Open Source without going through the Microsoft-approved Novell path," Wickline said. I think it is a matter of precedent. If both wish to seek a means to manage development and respect one another's patents and IP, then it begins to explain the basis for this cooperation.
It establishes, if not a legal precedent, an operating framework where users of IP - entirely lawful and otherwise, may develop "commercialized" solutions - be they on Microsoft's proprietary platform, or Novell's model. In either case, both win and both establish the basis for defending their IP. It forces those who develop commercial products that also use OSS to move similarly, or face both Microsoft and Novell. It also establishes a working model that Microsoft can carry to the EU and other markets. It defines how each may respect the properties each owns and manages. For those looking for the "bad" in this - why? Two companies and their leaders are working together. They represent two different ideologies, yet they have found a way to work with one another. That is a good thing and even if they fail, the effort is also a good thing. Where it benefits our customers, we ought to take advantage of it.
