Study: Microsoft patents could threaten Linux | |

A total of 283 registered software patents, including 27 held by Microsoft Corp. could conceivably be used as the basis of patent lawsuits against the Linux kernel, according to a study of U.S. software patents scheduled to be released Monday. The study was funded by Open Source Risk Management LLC (OSRM), a company that provides insurance against lawsuits related to the use of open source products, and conducted by patent attorney Dan Ravicher, executive director of the Public Patent Foundation and senior counsel to the Free Software Foundation. | ||

Software patents are for protecting assets. The merits of having them outweigh the problems of their absence (a topic not worth debating fully here, but should be touched upon). Having said that, it's valuable to have a patent on technology for any company creating a technology.
This is (yet another) problem with open source. It tends to leverage technology that other people have created. #2 sees this as a benefit. I agree, except when it steps on the toes of technology that is "owned" by another party. Whispers of this go all the way back to the SCO/Linux lawsuit stuff that is still going on today. Since there is no one company (except perhaps SCO) who manages and leverages OSS technologies, those assets are never protected. It might come as a benefit to some -- it would appear everything is free and open! technology for the masses! -- but it doesn't provide any incentive for a technology company to create anything, because there is no protection for that technology. The laws designed to protect technologies go above and beyond open and closed source -- it makes no difference how the technology is distributed. |
