People looking to off-load their old Microsoft software to make way for Windows XP have to be careful about selling it online. For more than a year, Microsoft employees have kept tabs on eBay and other online auctions for software sales that the company believes violate its copyright or trademark rights. When they surface, Microsoft and the auction house work together to shut them down. Under the licensing agreement with Microsoft, people who buy a computer with pre-loaded software cannot break out the software and sell it. But if they buy the software separately, they can sell it. | ||

#4. I don't have a problem with honest criticism of Microsoft. They aren't perfect. But I do have a problem with uninformed bigotry towards Microsoft.
You may not like that word, but it is appropriate in many cases because the type of hatred I see towards Microsoft is very similar to the hatred towards Jews in Israel. |

OK as far as your book analogy goes . . . Do you sell 10 pages out of your book? No you don't. You sell your entire book.
Its the same thing with a CD. Do you sell part of your CD or the whole thing? Now lets take your computer. You can sell your computer with software etc... because that is the whole product (just a lot more pieces). There is nothing wrong with selling your entire computer OS et all... Understand now? Easy huh? |

OEM copies are different. They are more software restore disks than retail. You are getting a big discount on XP when you buy it with a new computer. Your software restore disk probably isn't going to be much good on someone elses computer as its not a full blown installer.
Also when you scrap your computer you are voiding the computer manufacturers warranty. If you received a full blown windows when you bought Windows that is one thing. But the OEM copy if far and again another. |

Actually I am not sure if you could sell 10 pages from your book. It depends on the book.
Some things you have to copy in its entirety or not at all. #34 you seem to want to get out of a legally binding contract that you agreed to when you decided to use Windows. If you don't like it feel free to use a competing OS. OEM's don't ship naked PC's for a lot of different reasons and MS is only one picture in the pie. Take a Dell PC. If you change the OS installed your support options are diminished a great deal. They only guarantee that their computers work with what they gave it to you as. Dell does preinstall alternate operating systems. If you want to get a different one feel free. You do have options. You agreed to the licensing terms. Its a legally binding contract. Get over it. If you don't like the terms of the contract then don't use the software. From what I hear Linux is getting better all the time and that new Mac OS X is supposed to be pretty slick. And both of those you can sell on eBay with no restrictions. |

Actually #34, I don't believe that OEMs are required to ship PCs with Microsoft OS. This was a big issue that was resolved back in the '95 Consent Decree. The issue did not come up again in the '98 trial, so I find it hard to believe that it is still true.
But if you can point to recent evidence suggesting that this is still true, I will admit I am wrong. The problem that OEMs have with shipping PC's sans the OS is that it doesn't cost them any less. Because maybe only 1% of customers want the PC this way, having to go out of their way to install a bare harddrive instead of one of the pre-imaged ones adds something extra. Notice that even when Dell sold desktops with RedHat Linux, they didn't cost any less. |
