The Brisbane maker of chips to let Xbox owners run software not sanctioned by Microsoft is goading the software behemoth to litigate or leave them alone. Aussiechip released for free to the internet last week details of how to make "mod chips" - microprocessors that alter the internal workings of a console - under a licence that requires anyone downloading the plans to issue proceedings in its home jurisdiction of Queensland, should they wish to sue.

the headline should read "criminals thumb nose at Microsoft". Because thats what they are. They are STEALING intellectual property... not just from Microsoft, but from third-party development houses.

It seems to me like there are a lot of people with a lot of spare time who are interested in wasting their time in useless activities.

I don't know if it is theft or not. By modifying the XBox what are you allowing to happen.
I think it's a collosal waste of time, certainly, but it's not going to cut in Microsoft's profit margin. It will simply sell more XBox units.
Here's my commercial idea for Microsoft to combat this...
Screen shows a game of Pong, with the little paddle going back and forth and the beeps and bloops...
Announcer: "When you're tired of playing with Linux on your XBox, consider using it for it's real potential and playing a real game."
screen morphs to Halo 2 demo.

#10 "The game console crowd are like the " .... pc crowd... absolutely no different. Just as you will find people allied with Nintendo, Sony and now Microsoft you find exactly the same on the pc side -> Nvidia vs ATI, Intel vs AMD, Windows vs Linux, you name it - there will always be those that blindly support their side. Before Sony came in it was always Nintendo vs Sega, who had the most powerful console, who had the better games etc etc. Things don't change.
As for the XBox being a stupid idea - I don't think so. Microsoft obviously saw an opportunity to make some money and they went with it. They always knew that they wouldn't make money to begin with. It just gives consumers a 3rd side to support, so now you have a Gamecube vs PS2 vs XBox fight going on.

CooCooCaChoo - Ahh, obviously someone who doesn't remember their history. Sony is a johnny come lately in the video game market. This loyalty thing you speak of doesn't exist. Kids buy the consoles because of the availability of cool games.

Good luck with that happening - the Gamecube is doing very well, especially in Japan, Nintendo's main goal with their consoles has always been to strive for profitability and that's where they have succeeded. Many people criticise them for that, that they should have done what Sony did and just open the platform up allowing anyone to write any game they like, but if they did that then all that would really happen is that they would have 5000 more titles, 4900 of which aren't worth loading up let alone playing. To each his/her own I guess, every company is doing something slightly different and Sony has more to 'fear'? from the Xbox than Gamecube does as the PS2 and Xbox basically target the same groups.
In the end it's really as simple as buying the console which has the most amount of games that you enjoy playing. The market share of that console and the number of titles available for that console are completely irrelevant. Note that for some this 'simple' choice isn't based on games but rather their devotion? to a particular company - which is why you find some people always choosing Nvidia or AMD or Windows or PS2.
