Java gets thrown out of Windows | |

A federal appeals court Thursday overturned a ruling that would have forced Microsoft Corp. to incorporate Sun Microsystems Inc.'s Java programming language in the Windows operating system.
The three-judge panel in Richmond, Virginia, said a lower court judge had erred by ordering Microsoft to carry its rival's software, a penalty the lower court judge said was necessary to make up for Microsoft's past misdeeds.
At the same time, the appeals judges upheld a lower court ruling that Microsoft had broken a 2001 legal settlement between the companies and infringed on Sun's copyrights. They sent the case back to the lower-court judge, U.S. District Judge J. Frederick Motz, for further proceedings.

What I don't understand is why the case would be sent back to a judge who - in the appeals court's view - made a bad judgement. I mean really, they've essentially just said "this guy's an idiot... what the hell was he thinking?" which they immediately followed with "... but I'm sure he's better now, and certainly qualified to make valid judgements on the same subject matter. Go get em, tiger!"
This can only lead to more litigation, more appeals, more legal fees, more publicity, and ... oh, wait... I think I just answered my own question. |

| Well, I think for Sun, having no Java preinstalled is better than having the MS JVM installed. the MS JVM, according to the previous 7 billion lawsuits, is frozen at JDK 1.1.4 (IIRC) whilst the Sun JVM is up to 1.4.1 with some siginificant changes occuring on and after 1.2. |

| #4 Microsoft stopped developing JVM due to the conflict with Sun. What would they continue developing it while they cannot distrube the application? |

No, you don't quite have it straight :) The initial Lawsuit was over a JVM that Microsoft was illegally modifying. At least that's the way _I_ understood it. TL |

#5: That's what I said. Sun sued MS to stop developing the MS JVM. Thus, the MS JVM was frozen in place at a JVM compatible with Java 1.1.4. Java is now v1.4.1 and is significantly different (or has significantly better features, rather).
MS was allowed to continue distributing the MS JVM until 2002 or 2003, and making security/critical fixes to it up until 2004. After 2004, not even really bad security vulnerabilities can be fixed :( |
