Microsoft's Tanager phone breaches Sendo patent too | |

Hugh Brogan, boss of British phone manufacturer Sendo, says that Microsoft is continuing to infringe its patent in Tanager, Redmond's latest smartphone reference design. "We have seen Tanager and yes, we believe that is also infringing," he told us today. However he couldn't say whether Tanager would be embroiled in the litigation that followed the messy divorce between Microsoft and its erstwhile star phone OEM. Earlier this month Brogan indicated that Sendo probably wouldn't sue Tanager OEMs, although the mere threat should be enough to concentrate their minds. | ||

| Exactly, if you believe a company is infringing a patent you belong ypu go after them; this suspended threat sounds like an attempt to intimidate more than enforcing your rights. |

| If there aren't any Tanager products yet and the current case's outcome would affect this scenario, why would you sue twice? |

No, it's a design. No products. No manufacturers. No ones buying it.
MS could throw away the design spec tomorrow and would not be guilty. If they get HTC or someone else to build them, and HTC starts selling them to Orange or AT&T or such, then I would expect Sendo to take action. i.e. He doesn't know the impact as yet but it very well may come up in the CURRENT case. "Earlier this month Brogan indicated that Sendo probably wouldn't sue Tanager OEMs" "Indicated" is a damn vague word. "Probably" is definitely very noncommital. This is also not a quote. This is what the "reporter" interpreted his words to mean. AND FOR GODS SAKES, HOW MANY TIMES DO I HAVE TO REMIND YOU GUYS OF YOUR HYPOCRISY TOWARDS THE "PATHETIC, SLANDEROUS, UNCREDIBLE" REGISTER. What you say could make sense for me, for you and probably most of the other people posting here but don't forget that lawyers minds work in different way and, even worse, they have an audience out there. "Are they completely uncredible or not?" Neither one nor the other. I agree that if everything would be black or white, absolute right or absolute wrong life would be much easier; unfortunately this privilege is precluded to human beings; for us "in media stat virtus". |
