Judge Orders Microsoft-Government Settlement Talks | |

The new judge overseeing the remainder of the Microsoft Corp. antitrust case on Friday ordered the government and company to enter into intensive settlement talks ahead of hearings on possible sanctions against the software giant. U.S. District Court Judge Colleen Kollar-Kotelly told a status hearing with the parties that the settlement talks should proceed "24 hours a day, seven days a week" until a deadline on Nov. 2. If no settlement emerges, Kollar-Kotelly said she then expects hearings to begin in March on what sanctions should apply to prevent future violations of antitrust law by Microsoft. The judge rejected a Microsoft request to narrow the scope of those possible remedies. | ||

I'll say it again, the Government had better start seriously be considering taking Microsoft up on its proposals because this judge is a very serious, no nonsense, fact only judge. Considering the appeal court has already invalidated the ridiculous remedy proposed by Judge Jackson (that's not even an issue in the court anymore - Microsoft has won that part already - no the supreme court will not change it so don't bother), the penalities she could impose will not be near as ridiculous as the Government requested.

I guess my point was that if this goes to trial either side is going to lose and not get exactly what they want. Microsoft obviously doesn't want anything to happen, and the Government was being absolutely ridiculous in some of their proposals.
It's in the best interest of both parties to negotiate. |
