Spam sent by fraud is made a felony | |

In the toughest move to date against unsolicited commercial e-mail, Virginia enacted a law Tuesday imposing harsh felony penalties for sending such messages to computer users through deceptive means. The law would be enforced against those who use fraudulent practices to send bulk e-mail, commonly known as spam, to or from Virginia, a state that is headquarters for a number of major Internet providers, including the nation's largest, America Online. The new statute adds criminal penalties for fraudulent, high-volume spammers. It outlaws practices such as forging the return address line of an e-mail message or hacking a computer to send spam surreptitiously. Those found guilty of sending more than 10,000 such deceptive e-mail messages in one day would be subject to a prison term of one to five years and forfeiture of profits and assets connected with these activities. | ||

| Foreign Spam is a problem...but ridding the U.S. based spam folks will be a major step in the right direction. Besides that, take a look at the last part of the story. I hope he has to move to China to continue his spam empire! |

I got just as much spam this morning as yesterday. Guess the law isn't enacted yet or all the spammers would be obeying it and wouldn't DARE break the law!

So AOL, Microsoft and Yahoo need to put together a '10 Most Wanted' list of spammers with a reward for their arrest. I could see John Walsh - “Tonight on America’s Most Wanted … A spammer, the lowest of the low, ranking right down there with Osama, Saddam, the MPA and RIAA”. They will interview Miss Peabody his third grade teacher “I don’t know where he went wrong. He was such a quiet boy.”
So what would happen to the spam business after the first spammer is notably tracked down by a bounty hunter and dragged back to Virginia for trial? I wonder if the threat of maximum security incarceration with bubba would change the minds of a few spammers. |

MadJo - Well that'd be a fraudulent address. I think it's funny in a sense... Any spam which is intended to make a person money means that the receipient needs to be able to contact the sender in some way. That right there means the sender is traceable. While I'd like to applaud the effort I see nothing in this law that will actually stop spam.
At the same time I see yet another law that can be used by law enforcement to obtain a users information with little to now "probable cause"... ..but what else is new.. |
