Microsoft sued for refusing source code | |

Sendo in November cancelled all cooperation with Microsoft when it was just weeks away from launching a mobile phone running on Microsoft software. Microsoft is a minority shareholder in Sendo. At the time Sendo declined to give all the reasons for the split, saying only that it had not been given access to so-called 'source code' which would allow it to tailor the software. It made clear there were more important reasons behind the move, but declined to give details for legal reasons. Sendo has filed the suit in Texarkana, Texas. Sendo went on to sign a contract with Microsoft rivals Symbian of Britain and Nokia of Finland, sacrificing a potential 300 million euro revenue stream from its Microsoft-based phone. It had already signed supply deals with many mobile telecoms carriers around the world. Had Sendo continued to work with Microsoft, it would have established the British firm as the leading partner in Microsoft's attempt to crack the mobile phone business. | ||

Interesting that you two accept Sendo's allegations as fact. Whatever happened to innocent until proven guilty?
Also, Bizazz, that is typical of every greedy person. Large corporations aren't the only greedy folks around. |

Because Microsoft tends to be declared innocent AFTER being proven guilty. Recent developments bear that fact. |

Very interesting. When a judge calls Microsoft a monopoly and enters a judgement to have the split in half, it's a valid judgement and sentence. When another judge enters a judgement to support the settlement of the Justice Department and 9 states (later joined by 7 addittional states) that's letting the guilty go free.
The thing of it is, TL, you are full of it. There was no ruling that Microsoft was innocent. In fact, the current settlement is VERY close to the settlement versions going around when Posner was moderating - yes that was before Bush and his new Justice Department entered the scene. The problem back then was that there were a few obstinate states (I believe that's what Posner called them) which refused to be reasonable, so the whole settlement deal was scrapped. In any event, even if there was some great and atrocious miscarriage of justice when Judge Kolar-Kotelly accepted the settlement, that doesn't excuse anyone else from violating the law. Microsoft's rights under the law should be protected as much as anyone else's. The law states that you are innocent until proven guilty. From a PocketPC website ...
"Sendo alleges that Microsoft took some proprietary work Sendo did on top of the MS Smartphone reference platform and gave it to other vendors who then released a very Sendo-like solution ..." Then again, Sendo couldn't get the device to run properly from the beginning. Then there was the story that Sendo disolved the partnership because MS would not give them the code. It remains to be seen. |
