Ashcroft Draws Microsoft Criticism | |

A Democratic congressman said Attorney General John Ashcroft should have recused himself from the Microsoft antitrust case because of the software giant's contributions to Ashcroft's 2000 Senate campaign, according to a letter released Thursday. Ashcroft has already bowed out of the Enron investigation, citing contributions received from the failed energy giant. "I am disappointed you have failed to take similar action in the Microsoft case, a matter involving a party from whom you also received sizable contributions, $20,000 in the 2000 election cycle alone," wrote Rep. John Conyers, the lead Democrat on the House Judiciary Committee. | ||

After all the appeals court already struct down most of their major arguments. |

| Ooh, quoted, thanks! The idea that most of the arguments were struck down is ridiculous. The Appeals Court remanded the Tying claim because the law is poorly defined in this case and the most appropriate tests were not applied, not because their isn't evidence; they still showed commingling of code was anticompetitive and illegal for a Section2 convicted monopolist. The issue of MS monopolizing the browser market was remanded because through all the confusion and obfuscation created by both the lawyers and technologiests, the Plaintiff's failed to define browser markets and because the networked markets (middleware, services, media) were still nascent so the effects weren't apparent. The Plaintiff's could probably still make a case on both these issues but dropped it. As for Section 2, MS was found guilty up and down the internet foodchain and they didn't take on issues like boot loaders and other markets like servers and niche apps. In any instance, whereever MS struck down an argument in the Section 2 claim, it didn't matter because there were one, two, or more pieces of evidence demosntrating anticompetive behavior with no benefit to the consumer--frequently MS provided the evidence themselves. |
